Play & Win Terms & Conditions
Play & Win Everyday is a VODACOM Lesotho Competition which shall apply the Terms and Conditions outlined hereunder.
1. Organizer of the Competition

4. Duration of the Competition
4.1 The Competition will run from 19th November 2018 (being the first day) and shall end on the 28 February 2019 (last day inclusive).
5. Acceptance of Terms and Conditions
5.1 All participants warrant that they have read and understood these Terms and Conditions which are available on the VODACOM website at www.vodacom.co.ls and VODACOM retail shops.
5.2 By subscribing to the Competition, participants confirm their acceptance and full understanding of these Terms and Conditions and agree:
5.2.1 to receive SMS communication and /or advertising from VODACOM on their mobile phones relating to the “Play & Win Everyday” campaign;
5.3 VODACOM reserves the right to cancel or amend the Competition and these Terms and Conditions at any time. Any changes will be posted on the VODACOM website at www.vodacom.co.ls and communicated via SMS.
5.4 In the event of a dispute regarding the Terms and Conditions, conduct, results, and all other matters relating to the Competition, VODACOM’s decision shall be final and no correspondence or discussion shall be entered into unless otherwise deemed necessary by VODACOM.
5.5 These Terms and Conditions shall remain in full force and effect for the duration of the Competition (not taking into account temporary suspensions hereof for technical or operational reasons, e.g. for repairs, planned maintenance or upgrades).
6. Eligibility to Participate in the Competition
6.1 The following persons are eligible to participate in the Competition:
6.1.1 Natural persons who are VODACOM customers during the duration of the Competition, except those specifically excluded under article 6.2 below.
6.1.2 If a winner is under 18 years, upon confirmation/ delivery of the prize other than voice and data prizes, the winner’s guardian must be present to redeem /collect it on the minor’s behalf and he /she must produce his/her ID together with the minors’ to prove that he/she is the legal guardian of the minor.
The following persons are excluded from participating in the Competition:
§ Employees of VODACOM Lesotho, including directors and contractors
§ Immediate family members of the above, being parents, spouses, siblings, and children.
§ Non-citizens of the Kingdom of Lesotho
§ Employees of any company directly collaborating with VODACOM for the purpose of executing this Competition
6.3 VODACOM reserves the right to disqualify any entry if it has reasonable grounds to believe that the entrant has breached any provision of the Terms and Conditions.
6.4 By participating in the Competition, entrants hereby warrant that all information submitted is true, current and complete.
7. Availability and accessibility of information
7.1 All information pertaining to the Competition shall be published on the VODACOM website at www.vodacom.co.ls and any queries relating thereto shall be submitted to the call center at 114.
7.2 VODACOM shall not release personal information about participants of the Competition to third parties unless such is required to comply with the governing law.
8. Participation (Opt in and out Mechanism)
8.1 To participate in the “Play & Win Everyday” Competition, a VODACOM customer shall dial the USSD code *777# and select Opt-in, or select Opt-in on the competition on My Vodacom App
8.2 Opting into and Opting Out of the Play & Win Everyday competition is FREE
8.3 Once a subscriber enters the Competition he/she will receive a welcome message acknowledging successful entry.
8.4 A participant can opt-out of the Competition at any timeby dialing the USSD code *777# and selecting Opt-out, or select Opt-out on the competition on My Vodacom App. If afterwards the subscriber wishes to participate again, he/she will be able to Opt-in again.
9. Competition mechanics
9.1 Each subscriber who has opted into the Play & Win Everyday competition will be awarded a Play i.e. Turn to try for a prize. Plays shall be awarded as follows;
§ Customers will receive a play when a bundle greater than M5 is purchased on USSD/ M-Pesa
§ Customers will receive 2 plays when a bundle greater than M5 is purchased on My Vodacom App
§ Customers will receive a play when they pay a Bill greater than M20 on M-Pesa
9.2 Customers will have an option to purchase Extra Plays at M1.00 per Play and there shall not be a limit on the daily Plays.
9.3 All Plays expire at midnight of the day of allocation
9.4 Prizes shall be randomly selected when a customer initiates a Play and all Plays will have an equal probability of winning a Prize.
9.5 There shall be a maximum number of times which a particular prize may be awarded on any given day and a prize which has exceeded the allocated wins shall no longer be available for redemption on the same day.
9.6 Daily voice and data prizes shall expire at midnight of the day of the award and other prizes shall be valid for the period assigned for redemption of the specific reward.
9.7 Subscribers who are entered into the daily, weekly and monthly draws shall stand a chance to win prizes daily, weekly and monthly respectively. However, the said customers shall nonetheless win instant prizes of 20 SMS for each Play.
9.8 Subscribers shall be able to view their prize history and available Plays on USSD and on My Vodacom App.
9.9 Prizes shall be determined by VODACOM in its absolute discretion and shall include instant SMS prizes for subscribers entered into the draw, daily voice and data bundles, lifestyle rewards, devices and cash prizes.
10. Notices and Redemption of Prizes
10.1 Winners shall be liable for payment of due taxes and collections of the prize under any relevant current legislation including any costs associated with the collection or redemption of the prize.
10.2 Winners shall sign an undertaking confirming that they are the legal holders of their mobile number and that they are entitled to the prize. All winners must provide identification documents in order to receive the prize. Prizes may be received by a representative of the winner by proxy upon written confirmation from the winner. The following documents shall be accepted for identification: ID card, Driver’s License or Passport.
10.3 By participating in the Competition, winners agree that their data, including names, surnames, initials, photos and video images, can be used by VODACOM for advertising purposes in connection with this or similar Competitions without prior consent and free of charge.
10.4 If a winner cannot be contacted/reached within thirty (30) calendar days from the Play date, or a notified winner refuses the prize or fails to appear to collect it within thirty (30) calendar days of notification, then the prize will remain the property of VODACOM and he/she will forfeit the prize.
10.5 Decisions made by VODACOM will be final and no correspondence will be entered into unless otherwise deemed necessary by VODACOM.
10.6 Prizes are not transferable.
11. Limitation of liability
11.1 VODACOM accepts no responsibility whatsoever including without limitation, any error, omission, interruption, defect, associated with the competition or delays in operation or transmission and, communications line failure.
12. Disclaimer of warranties
12.1 Participants understand and agree that they participate in this Competition at their own risk and willingness and have not been coerced in any manner to enter.
12.2 VODACOM makes no warranty, implied or express, that any part of the Competition will be uninterrupted and error-free.
12.3 Neither VODACOM nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the Competition or as a result of accepting the prize.
12.4 VODACOM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials associated with the Competition .
12.5 By entering the Competition, participants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against VODACOM, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage.
13. Data protection and Publicity
13.1 Personal data related to voice, image, name or address and any other relevant information obtained in connection with the Competition will be used in a confidential manner and in line with the Vodacom Privacy Management Policy.
14. Suspension and termination of the Competition
14.1 VODACOM reserves the right whenever is deemed necessary to temporarily suspend the Competition for operational reasons (e.g. for repairs, planned maintenance or upgrades) and undertakes to restore same in its discretion as soon as possible after any temporary suspension period.
14.2 Interruption or early termination of the Competition shall not release VODACOM from its obligation to give out already awarded prizes and to execute all other actions required to give effect to such except for the cases when termination or interruption of the Competition resulted from actions or events which are not under VODACOM’s control.
15. Governing Law
15.1 In any case of disagreement or disputes arising in connection with this Competition, participants can present their complaint to VODACOM for amicable resolution and if a dispute is not resolved within fourteen (14) days of an attempt to resolve such, the aggrieved party shall lodge a complaint with the Lesotho Communications Authority (LCA) and shall further be at liberty to exercise any other rights or remedies in law.
