Win-Sum-More-Campaign Terms & Conditions

Vodacom Win-Sum-More Campaign (hereinafter referred to as the “Campaign”) is a Vodacom Lesotho marketing Campaign which shall apply the Terms and Conditions outlined hereunder.

1. Organizer of the Campaign

1.1 VODACOM LESOTHO (Pty) Ltd (hereinafter referred to as “VODACOM”)

4. Duration of the Campaign

4.1 The Campaign will run from 16 November 2020 (being the first day) to 08 February 2021(last day inclusive). Last day entries being 07 February 2021 are eligible for the daily and weekly draws shall take place on Monday 08 February 2021.

5. Acceptance of Terms and Conditions

5.1 By participating in this Campaign, all entrants warrant that they have read and understood these Terms and Conditions which are available on the VODACOM website at and VODACOM retail shops.

5.2 By subscribing to the Campaign, entrants confirm their acceptance and full understanding of the Terms and Conditions and agree:

5.2.1 to receive SMS communication from VODACOM on their mobile phones relating to the Campaign; and

5.2.2 to receive SMS communication/advertising offers from VODACOM relating to the Campaign.

5.3 VODACOM reserves the right to cancel or amend the Campaign and these Terms and Conditions at any time. Any changes thereto will be made available on the VODACOM website at and VODACOM retail shops.

5.4 These Terms and Conditions shall remain in full force and effect for the duration of the Campaign (including temporary suspensions hereof for operational reasons, e.g. for repairs, planned network maintenance or upgrades).

6. Eligibility to Participate in the Campaign

6.1 The following persons are eligible to participate in the Campaign:

6.1.1 Natural persons who are citizens and/or residents of Lesotho and are VODACOM customers during the Campaign except those specifically excluded under article 6.2 below.

6.2 Excluded persons

The following persons are excluded from participating in the Campaign:

6.2.1 Employees of VODACOM;

6.2.2 Immediate family members of the VODACOM employees; being parents, spouses, siblings, and children. Immediate family does NOT include in-laws, close relatives such as cousins, uncles, aunts, nephews and nieces, grandparents, and other extended family members;

6.2.4 Non-citizens of the Kingdom of Lesotho who are not legitimately in the country or who fail to provide any documents as may be requested by Vodacom to validate their legitimate stay in Lesotho; and

6.2.5 Employees of any company directly collaborating with VODACOM for the purpose of executing this Campaign.

6.3 VODACOM reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any provision of the Terms and Conditions or falls within the exclusion list under section 6.2 above.

6.4 By participating in the Campaign, entrants hereby warrant that all information submitted is true, current and complete and agree to have the same verified by Vodacom.

7. Availability and accessibility of information

7.1 All information pertaining to the Campaign shall be published on the VODACOM website at and VODACOM retail shops, and any queriesrelating thereto may be submitted to the VODACOM customer care call center at 114.

7.2 VODACOM shall not release personal information about participants of the Campaign to third parties unless required to do so in compliance with the governing law.

8. Campaign Mechanics

8.1 The Campaign shall be open to Prepaid, Top-Up, and Post-Paid customers who are not excluded by the aforementioned eligibility termsin clause 6 and who participate therein voluntarily.

8.2 Cash prizes shall be delivered through M-Pesa to minimize the spread of COVID-19. Customers shall not be required to register for M-Pesa and those who are not registered for M-Pesa and do not wish to do so shall receive cash redeemable tokens which shall be valid for seven (7) days from receipt. Vodacom reserves the right to validate the participants’ identity and request additional information where necessary.

8.3 To participate in the Campaign, customers shall subscribe by dialing *777# and then selecting Opt-In on the USSD menu.

8.4 Customers shall be eligible to participate by purchasing the approved Voice and data bundles, Ticket Bundles (Video, Social, Music), Just4You Bundles, Next Level (NXT LVL) bundles and through Spend & Get.

8.5 Customers who have opted into the Campaign shall be entered into daily and weekly draws where they shall stand a chance to win cash prizes and non-cash prizes outlined under Section 9.

8.6 Draw Mechanics

8.6.1. Qualifying days shall start on Monday 16 November 2020, at 00:00:01 Hours and end at 23:59:59 Hours on Monday 08 February 2021.

8.6.2. Different cash prizes may be won, depending on the spend value as stipulated under Annexure 1.

8.6.3 Daily draws shall be only on Monday to Friday and shall be on the day following the day of spend or purchase. For clarity, for daily draws, eligible spend shall be spend or purchases undertaken from Sunday to Thursday.

8.6.4 Daily draw winners shall be announced on Fridays on Vodacom’s social media platforms. Weekly draws winners shall be announced on Mondays.

8.6.3. Weekly draws shall be done on Mondays and shall consider, all qualifying entrants in the preceding week including Fridays and weekends i.e. Saturday and Sunday. These shall be customers who purchased bundles listed under 8.4 during the qualifying week and those who met the requirements under the approved Spend and Get proposition.

8.6.4 Customers who reach their weekly spend target under Spend and Get shall get an automatic double entry into the weekly draws. VODACOM WIN-SUM-MORE CAMPAIGN Terms & Conditions 3 C2 General

8.6.5 A subscriber cannot win more than one cash prize in the qualifying or same week. However, a customer can win under a Daily Draw and a Weekly Draw in the same week.

8.6.6 A participant can opt-out of the Campaign at any time by dialling *777# and selecting Opt-Out.

8.6.7 Customers who have opted out shall be allowed to participate again by opting in through the mechanisms provided under this clause 8, and they will start receiving related messages again.

8.7.8 Customers shall not be charged to opt in and out of the Campaign.

9. Prizes

9.1 Prizes shall include Cash Prizes and non-cash prizes such as Smartphones, Shopping Vouchers and Scratch Cards redeemable at Vodacom Shops nationwide. Cash prizes shall be to the tune of nine hundred thousand (M900, 000.00), and non-cash prizes shall be valued at one hundred and twenty -six thousand, seven hundred and thirty-six Maloti (M125, 736.00) for the Campaign duration.

9.2 Cash prizes shall be delivered through M-Pesa. Customers shall not be required to register for M-Pesa and those who are not registered for M-Pesa and do not wish to do so shall receive cash redeemable tokens.

9.3 Customers further agree to have their identity validated and authenticated by Vodacom where necessary.

10. Notices and Redemption of Prizes

10.1 All winners may be contacted by VODACOM via SMS and/or a phone call to their MSISDN number used to participate in the Campaign.

10.2 All winners will receive notices within three (3) calendar days from the date of the draw via SMS.

10.3 All prizes will be delivered within 14 (fourteen) to twenty-one (21) working days from the day that the winner is contacted.

10.4 Winners shall be liable for payment of due taxes under any applicable legislation including any costs associated with the collection or redemption of the prize.

10.5 By participating in the Campaign, winners agree that their data, including names, surnames, initials, photos and video images, can be used by VODACOM for advertising purposes having obtained consent from Customers and free of charge.

10.6 If a winner cannot be contacted within thirty (30) calendar days from the draw date, or a notified winner refuses the prize or fails to appear to collect it within thirty (30) calendar days of notification, then VODACOM will contact the runner-up winner (s) who will be awarded the prize(s). If none of the winners or runner-up winners accept the prize or do not show up within thirty (30) calendar days of notification, then the prize will remain the property of VODACOM.

10.7 Prizesshall not be transferable.

11. Limination of Liability

11.1 VODACOM accepts no responsibility whatsoever including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution.

12. Disclaimer of warranties

12.1 Participants understand and agree that they participate in this Campaign at their own risk and willingness and have not been coerced in any manner to enter. VODACOM WIN-SUM-MORE CAMPAIGN Terms & Conditions 4 C2 General

12.2 VODACOM makes no representations or warranties, implied or express, that any part of the Campaign will be uninterrupted and error-free.

12.3 Neither VODACOM nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, harm or disappointment suffered by any entrant participating in the Campaign or as a result of accepting the prize.

12.4 By entering the Campaign, entrants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against VODACOM, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage.

13. Data protection and Publicity

13.1 Personal data related to voice, image, names or address and any other relevant information obtained in connection with the Campaign will be used in a confidential manner and in line with the Vodacom Customer Statement. Click the link to access the Vodacom Privacy Statement.

14. Suspension and termination of the Campaign

14.1 VODACOM reserves the right, whenever deemed necessary, to temporarily suspend the Campaign for operational reasons (e.g. for repairs, planned maintenance or upgrades) and undertakes to restore same as soon as possible after any temporary suspension period.

14.2 Interruption or early termination of the Campaign shall not release VODACOM from its obligation to give out already awarded prizes and execute all other actions required to give effect to such except for the cases when termination or interruption of the Campaign resulted from actions or events which are not under VODACOM’s control.

15. Dispute Resolution and Governing Law

15.1 In any case of disagreement or disputes arising in connection with this Campaign, participants can lodge their complaint with VODACOM for amicable resolution. Engagements with Vodacom shall be through private negotiations.

15.2 Notwithstanding the above, participants may lodge their queries and complaints with Vodacom in line with Vodacom Customer Guidelines and Procedure available on the Vodacom website ( in both Sesotho and English.

15.3 Participants shall further be at liberty to exercise any other rights or remedies available in law.

15.4 These Terms and Conditions shall be deemed to have been made under the laws of the Kingdom of Lesotho and shall be read, construed and given effect to in accordance with the laws of the Kingdom of Lesotho.
