General Terms and Conditions Applicable to Vodacom Lesotho Competitions, Challenges and Campaigns


These terms and conditions apply to Competitions, Challenges, and Campaigns run by Vodacom Lesotho, “Vodacom” for its customers.

For these terms and conditions,

  1. Definitions
    1. "Affiliate" means our partners, co-promoters, and sponsors of our campaigns/challenges/competitions, our subsidiaries, and their subsidiaries and respective holding companies and their directors, officers, employees, agents, and representatives.
    2. “Entrant or Participant” means a Vodacom subscriber who participates in Vodacom’s offer(s).
    3. “Offer” means any Competition, Challenge, and Campaign offered by Vodacom
    4. “We” or “Us” means Vodacom, including our affiliates.
    5. “You” or “Your” means a person participating in any offer.

  2. Acceptance of Terms and Conditions
    1. By participating in any Offer(s), entrants warrant that they have read and understood these Terms and Conditions, which are available on the Vodacom website (www.vodacom.co.ls) and at all Vodacom retail stores.
    2. By subscribing to any Offer(s), entrants confirm their voluntary participation and acceptance of these Terms and Conditions and agree:
      1. to receive SMS communication from Vodacom on their registered mobile phones relating to the Offer(s).
      2. to receive SMS communication or advertisements from Vodacom relating to the Offer(s).
      3. that by participating in any Offer(s), their data, including names, surnames, initials, photos, and video images, may be used by Vodacom for advertising purposes.
      4. that by participating in any Offer (s), they warrant that all personal information submitted where such is required is true, current, and complete.
      5. that Vodacom reserves the right to disqualify any entrant if it has reasonable grounds to believe that the entrant has breached any provision of the Terms and Conditions.

  3. Eligibility
    1. Vodacom Offers apply to Natural persons who are Vodacom subscribers and are eligible to be part of an Offer.
    2. Excluded persons:
      1. Employees of Vodacom.
      2. Immediate family members of the above (Vodacom employees), being parents, spouses, siblings, and children. Immediate family does NOT include in-laws, close relatives such as cousins, uncles, aunts, nephews, nieces, grandparents, and other extended family members.
      3. Employees of Offer suppliers or of any company directly collaborating with Vodacom to execute the Offer.
      4. Non-citizens of the Kingdom of Lesotho who are not legitimately in the country or may fail to provide any valid documents confirming legitimate stay or legal recognition as may be requested by Vodacom.
      5. Subscribers below the age of 18, except for Offers whereby minor participation is permissible or where offers apply to specific product segments, e.g., NXT LVL.

  • Prizes
    1. Offers may include prizes as determined by Vodacom.
    2. Prizes won from any Offer are not transferable and may not be deferred, changed, or exchanged for any other item.
    3. If a winner is unreachable after the number of days designated for collection, they shall forfeit their prize.
    4. Where a winner does not meet the eligibility criteria, they shall be disqualified from receiving the prize, and where he or she is unreachable when contacted and/or for their prize delivery, he or she shall forfeit the prize and/or there shall be substitute winners.
    5. Winners shall be verified through their identity documents to receive their prizes.
    6. Collection of prizes shall be at the winner's cost unless otherwise advised by Vodacom.

  • Winner Announcement
    1. Winners shall be contacted by Vodacom via SMS and/or a phone call on their MSISDN number used to participate in the Offer(s).
    2. Winners may be announced on selected radio stations and/or Vodacom’s social media pages or such platforms as may be determined by Vodacom in its absolute discretion.

  • Disclaimer
    1. Vodacom shall not be liable for any claims relating to such losses or injuries (including special, indirect, and consequential losses), damages, rights, claims, and actions of any kind that may be brought against the Company, its parent companies, affiliates, directors, officers, employees, or agents, resulting from negligence or fault or any other cause, which is suffered by you during your participation on any of our Offers, acceptance or user of any prize, including without limitation, personal injuries, death, and property damage.
    2. Participants understand and agree that they participate in the Offers willingly and at their own risk and have not been coerced in any manner to enter.
    3. Vodacom makes no warranty, implied or express, that any part of the Offer will be uninterrupted and error-free.
    4. Vodacom is not responsible for any problems or technical malfunction of any communications network or lines, computer online systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials associated with the Offer.

  • Suspension and termination of the Offer
    1. Vodacom reserves the right, whenever deemed necessary, to vary, postpone, suspend, or cancel any Offer or any aspect thereof, within reasonable notice, at any time and for any reason that we deem necessary. In the event of such variation, postponement, suspension, or cancellation, you agree to waive any rights, interests, and expectations that you may have in terms of the Offer and acknowledge that you will have no recourse against us.
    2. Any Interruption or early termination of any Offer shall not release Vodacom from its obligation to give out already awarded prizes and execute all other actions required to give effect to such which is accrued at the time of suspension or termination except for the cases when termination or interruption of the Offer resulted from actions or events which are not under Vodacom’s control.

  • Your responsibilities
    1. It is your responsibility to ensure that your participation in any Offer is received by us before the expiry of the same. Any attempts or participation that is not received by us before the expiry of the Offer will not count.,
    2. It is your responsibility to ensure that any information which you provide to us is accurate, complete and up to date.
    3. You must possess relevant documents and/or obtain necessary permissions that may be required to accept an Offer and/or participate in any Offer(s). It is your responsibility to obtain such documents and permissions at your own cost and such documents and permissions must be valid at all times.
    4. We may require you to provide us with such additional information and documentation as we may require to process, confirm, and facilitate your acceptance of an Offer. If you fail to provide us with the requested information or documentation, the Offer will automatically lapse without further correspondence or liability with you.
    5. If you fail to comply with any of the Terms and Conditions, you will be automatically disqualified, and any prize will automatically lapse.
    6. Vodacom’s decision on any matter concerning the Offer arising out of these Terms and Conditions is final and binding on you, and no correspondence will be entered into.

  • Charges
    1. Participation in any of our offers will have clear mechanics and may include charging you. Where applicable, you will be charged for your participation in any offer(s) at specified rates, which may vary for each offer. Unless we state otherwise, "Free" resources (Voice, data, SMS, etc.) under any tariff Plan do not apply.
    2. The airtime, any applicable resource, and/or payment costs incurred from participating in any Offer shall not be recoverable, save where this is caused by the fault of Vodacom, in which case the customer will be refunded.

  • Dispute Resolution
    1. In any case of disagreement or disputes relating to Vodacom’s decision relating to any Offer(s), participants shall lodge their complaints with Vodacom for an amicable resolution of the same which shall be settled through private good faith negotiations.
    2. 10.2 Please note that Our Complaints Handling Procedure, which is outlined in the Vodacom Consumer Protection Code, shall apply to any complaints arising from any Offer. The Code is available on our website (www.vodacom.co.ls)
    3. 10.3 These Terms and Conditions will be construed, interpreted, and enforced in accordance with the laws of Lesotho.

  • Miscellaneous
    1. 11.1 These Terms and Conditions form part of the General Prepaid Terms and Conditions.
    2. 11.2 Vodacom shall have specific Terms and Conditions applicable to specific Offer(s) implemented under these Terms and Conditions. Specific Terms and Conditions shall be available on our website (www.vodacom.co.ls) .
    3. 11.3 If there is any difference between these Terms and Conditions and the specific Terms and Conditions, the specific Terms and Conditions will apply.
